What is the purpose of Form Instructions 2553?
Form Instructions 2553 is used to update: a. The record (Form 2620) when an applicant or employee who is subject to tax returns under the Social Security Act is no longer subject to these returns, b. A record (Schedule C) of the employee's account balance or total refundable credits as a result of any reduction for refund ability of employee deductions due to an adjustment to the IRS employee tax tables or c. An administrative statement for the IRS to send to the employee or any dependent(s) who was the beneficiary (employee's legal child or legal ward) of the taxpayer who filed the tax return. What are the penalties for not filing Form Instructions 2553 and other required returns? Failure to file Form Instructions 2553 will result in penalties of 50% of the amount not filed, and 30% of the amount of the tax for which the return must be filed. For example: A taxpayer who files Form 2553 but does not file Form 706 with the other required returns, may not file a refundable credit portion of the tax return for that year in any year.
