FAQ - Form Instructions 2553

What is the purpose of Form Instructions 2553?
Form Instructions 2553 is used to update: a. The record (Form 2620) when an applicant or employee who is subject to tax returns under the Social Security Act is no longer subject to these returns, b. A record (Schedule C) of the employee's account balance or total refundable credits as a result of any reduction for refund ability of employee deductions due to an adjustment to the IRS employee tax tables or c. An administrative statement for the IRS to send to the employee or any dependent(s) who was the beneficiary (employee's legal child or legal ward) of the taxpayer who filed the tax return. What are the penalties for not filing Form Instructions 2553 and other required returns? Failure to file Form Instructions 2553 will result in penalties of 50% of the amount not filed, and 30% of the amount of the tax for which the return must be filed. For example: A taxpayer who files Form 2553 but does not file Form 706 with the other required returns, may not file a refundable credit portion of the tax return for that year in any year. Therefore, because the taxpayer will owe tax on the deficiency, he or she will avoid the return and its penalty of 30% of the amount of the tax that could have been filed if the other required return(s) had been filed. The penalties due can be collected by the IRS. When filing the Form 2553 and other required returns, the taxpayer is required to include the required information regarding income and deduction items. However, if a return is filed incorrectly, the failure may result in the denial of return and penalty. For example, if the return includes incorrect information to identify an employer, the return may be denied. Also, the failure to provide a copy of any Form 1040 Form 1045 Form 1047 Form 1096 Form 8938 Form 1099, Form W-2, Form W-8 or other information required by law to be filed with the return may result in a penalty being assessed. If the taxpayer chooses to file Form 1094, Form 1095 or any other report required by law, the return will need to be completed and signed. The taxpayer should mail Form 1094, Form 1095, Form 1047 or Form 1096 directly by certified mail. The taxpayer must mail Form 2442, Report, Taxable Income of Nonresident Alien Individual or Business, or Form W-2 for an employee, not the address above.
